The ASPS, ABPS, and the Utah Plastic Surgery Society (UPSS) recently received important legal support in the 10th District U.S. Courts of Appeals in Denver, CO. The appellate court upheld the dismissal of a lawsuit that had been filed against these organizations, challenging their patient education campaign, and was subsequently dismissed in a lower court.
This event marks a significant legal victory for ASPS, ABPS, and UPSS. The plaintiffs’ contention was that the promotion campaign of these organizations had caused a loss of business to non-plastic surgeons. The decision of the Court of Appeals serves to reaffirm the validity of the ‘Do Your Homework’ public education campaign of the ASPS to increase patient awareness and safety.
The argument of the plaintiffs was the campaign was designed to mislead the people because it differentiated between cosmetic surgeons and other surgeons. The Appeals Court, however, arrived at a conclusion that there was no actual violation on part of the defendants, and upheld the previous ruling in favor of the ASPS, ABPS, and others.
Improving Awareness
The president of the UPSS, Brian Brzowski, said that the court’s decision underscores the importance of generating public awareness on the difference between a trained and qualified plastic surgeon and another surgeon who present themselves as similarly skilled. The message is clear that patients need to be more aware, appreciate the key differences, and choose the right surgeon for their needs.
